TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURPLE TRUNK AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO US THROUGH THE SITE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Purple Trunk and its owners, affiliates, officers, employees, agents, licensors, and service providers from claims, liabilities, damages, judgments, losses, and reasonable costs arising out of your unlawful misuse of the Site, your material breach of these Terms, or your infringement of another person’s rights. We reserve the right to control the defense of any matter subject to indemnification, and you agree to cooperate reasonably with that defense.
We may suspend, restrict, or terminate access to the Site, or modify or discontinue any Site feature, at any time when reasonably necessary for security, maintenance, legal compliance, protection of rights, or business reasons. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute provisions.
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws principles. Any dispute arising from or related to these Terms or the Site that is not required by law to be heard elsewhere will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to their jurisdiction. Nothing in these Terms limits any non-waivable consumer protection right or lawful right to bring a claim in another forum.

If a change is material, we will provide additional notice appropriate to the change when required by law. Changes apply prospectively.
